These Terms & Conditions (“Terms”) govern your use of this website and any recruitment, staffing or related services provided by Index Point Agency (“we”, “us”, “our”) in Denmark.
1. Scope and Acceptance
By using our website, contacting us, applying for work, or engaging our staffing services, you accept these Terms. If we sign a separate written agreement with a client, that agreement prevails in case of conflict. We operate in Denmark and comply with applicable Danish law, including the Danish Marketing Practices Act, the Temporary Agency Workers Act (vikarlovgivning) and the GDPR.
2. Definitions
“Client” means a company requesting workers or recruitment services. “Worker” or “Candidate” means an individual who applies for, is introduced for, or performs an assignment. “Assignment” means a temporary or permanent role we source or staff.
3. Website Use
Our website provides information about our services and enables interested individuals to contact us. We own all content unless stated otherwise. Do not copy, misuse, disrupt, or attempt to access data without permission. External links are provided for convenience; we are not responsible for third-party sites.
4. Data Protection (GDPR)
When you contact us or apply, we may process your name, contact details, CV information and documents you provide. We process this data to respond to inquiries, evaluate suitability, match workers to roles, and deliver services. We do not sell personal data. And do not share it with third parties except when necessary to deliver a service (for example, sharing a candidate profile with a client) or when required by law. 5. Services for Clients
Clients may request workers or recruitment by contacting us with role requirements, location, start date, certifications, schedule and other relevant details. We will confirm scope, rates and service terms in writing before deployment. Unless otherwise agreed, staffing is delivered in Denmark only.
5.1 Rates, VAT and Invoicing
All fees are quoted in DKK and are subject to Danish VAT (MOMS) where applicable. Minimum chargeable hours per worker per day may apply [e.g., 4 hours]. Clients approve hours via timesheet or agreed digital method. We invoice based on approved hours and agreed rates. Payment is due within 14 days of invoice date. Late payment accrues statutory interest under the Danish Interest Act and reasonable collection costs. We may suspend services for overdue accounts.
5.2 Cancellations and Changes
If a confirmed Assignment is cancelled or postponed within 24 hours of start, a cancellation fee equal to 4 billable hours per booked worker may apply. We will communicate promptly if substitution or rescheduling is needed.
5.3 Replacement and Service Quality
If a worker is unsuitable, notify us within the first 4 working hours. We will attempt a reasonable replacement at no extra agency fee for the remaining shift. This is the client’s exclusive remedy for unsuitability.
5.4 Direct Hire / Transfer
If a client hires (directly or via affiliate) a worker we introduced or staffed within 12 months of the introduction/last Assignment, a transfer fee applies: 18% of the worker’s estimated annual gross remuneration or a fixed fee of DKK 35,000, whichever is higher. This compensates sourcing, screening and administration.
5.5 Client Responsibilities (HSE & Compliance)
The client provides a safe workplace, supervision, instructions, site inductions, and required PPE unless otherwise agreed. He complies with applicable working environment rules and equal treatment obligations. Also the client is responsible for site-specific risks, access, tools and day-to-day control of work.
6. Terms for Workers / Candidates
Applying or accepting an Assignment does not guarantee ongoing work. You must provide accurate information, hold the right to work in Denmark where required, and follow site safety rules and reasonable instructions. If we are the employer for a temporary Assignment, pay and conditions are set out in your employment terms and applicable Danish law, including equal treatment where relevant. If a client is the employer, their employment terms apply. Timesheets must reflect actual hours worked. Misrepresentation or breach of site rules may end an Assignment.
7. Liability and Insurance
We maintain business insurances customary for our services. We are not liable for indirect or consequential losses, loss of profit, loss of data or production. Our aggregate liability for any claim arising out of a service is limited to the lower of (a) the fees paid by the client to us for the Assignment giving rise to the claim in the three (3) months preceding the event, or (b) DKK. Nothing limits liability for death or personal injury caused by negligence, fraud, or liability that cannot be excluded under Danish law.
8. Non-Solicitation and Fair Dealing
Clients agree not to solicit our staff to bypass our services during an ongoing Assignment and for [6] months thereafter, except via the transfer fee in clause 5.4. Workers agree not to solicit clients to bypass the agency in relation to the Assignment.
9. Anti-Discrimination and Ethics
We do not tolerate discrimination, harassment, forced labour, illegal work, or bribery. Selection and placement are based on objective role requirements and lawful criteria. Report concerns to ethics@indexpoint.agency.
10. Marketing and Communications
We may contact clients and candidates about an active inquiry or Assignment. We do not use personal data for unrelated marketing without consent. You can opt out of non-essential communications at any time.
11. Pricing and Accuracy
We aim for accurate and current information. Quotes, availability and role descriptions are subject to confirmation. We do not guarantee continuous website availability.
12. Changes to the Terms
We may update these Terms to reflect legal, technical or business changes. The “Last updated” date shows the latest version. Significant changes will be communicated when feasible. Continued use of the website or services after changes constitutes acceptance.
13. Governing Law and Disputes
These Terms are governed by Danish law. The courts of Denmark have exclusive jurisdiction, with venue at the City Court of Copenhagen (Københavns Byret), unless mandatory rules provide otherwise.
